What is copyright?

Copyright is a form of protection provided for original works of authorship, including literary, dramatic, musical, graphic and audiovisual creations. "Copyright" literally means the right to copy, but has come to mean that body of exclusive rights granted by law to copyright owners for protection of their work.

What is copyright infringement?

Copyright infringement occurs when a copyrighted work is reproduced, distributed, performed, publicly displayed, or made into a derivative work without the permission of the copyright owner.

Posting copyright-infringing content

This can lead to the termination of your account, and possibly monetary damages if a copyright owner decides to take legal action (this is serious—you can get sued!). Below are some guidelines to help you determine whether your video is eligible or whether it infringes someone else's copyright. As a general matter, we at MediaSpurr respect the rights of artists and creators, and hope you will work with us to keep our community a creative, legal and positive experience for everyone, including artists and creators.

How To Make Sure Your Video Does Not Infringe Someone Else's Copyrights

The way to ensure that your video doesn't infringe someone else's copyright is to use your skills and imagination to create something completely original. It could be as simple as taping some of your friends goofing around, and as complicated as filming your own short movie with a script, actors, and the whole works. If it's all yours, you never have to worry about the copyright—you own it! Make sure to follow the other guidelines in the terms & conditions, too.

Be sure that all components of your video are your original creation—even the audio portion. For example, if you use an audio track of a sound recording owned by a record label without that record label's permission, your video may be infringing the copyrights of others, and may be subject to removal.

Examples of copyrighted work

In general, any original work of authorship may be protected by copyright. Copyrighted materials may be subject to claims of copyright infringement. The most common reason we take down videos for copyright infringement is that they are unauthorized copies of copyrighted content, and the owners of the copyrighted content have alerted us that their content is being used without their permission. Once we become aware of an unauthorized use, we will remove the video promptly.

Some examples of potentially infringing content are:

TV shows

o Including sitcoms, sports broadcasts, news broadcasts, comedy shows, cartoons, dramas, etc.
o Includes network and cable TV, pay-per-view and on-demand TV

Music videos

Such as the ones you might find on music video channels

Videos of live concerts

o Even if you took the video yourself, the performer controls the right to use his/her image in a video, the songwriter owns the rights to the song being performed, and sometimes the venue prohibits filming without permission, so this video is likely to infringe somebody else's rights.

Movies and movie trailers

Commercials

Slide shows that include photos or images owned by somebody else

Claimed Content

Some content owners choose to make their content available for use on MediaSpurr. If you upload content that is owned by one of MediaSpurr’s Content Identification partners, your video may be claimed by them. It is your responsibility to know whether or not the use of the content you wish to upload is authorized. Keep in mind that rights ownership or licensing can change!

MediaSpurr Copyright Policy: Consequences of uploading copyrighted material

Anytime MediaSpurr becomes aware that a video or any part of a video on our site infringes the copyrights of a third party, we will take it down from the site as required by law. If you believe that a video on the site infringes your copyright, please send us a copyright notice and we'll take it down. If you believe we've removed a video that you uploaded in error and that you are the copyright owner or have permission, you can file a counter notice and let us know. Accounts determined to be repeat infringers may be subject to termination. Users with suspended or terminated accounts are prohibited from creating new accounts or accessing MediaSpurr's community features.

Using some copyrighted content

It's possible that you may be permitted to include small excerpts from copyrighted material in your video if what you intend to use is insubstantial or is incidentally included, or where the intended use you have for the copyrighted material falls within a exception or limitation to copyright under the law in your country.
We can't give you advice on either of these topics, and if you do plan to use even a small portion of copyright material in your video we'd strongly advise you to take legal advice first.

To file a copyright infringement notification with us, you will need to send a written communication that includes substantially the following (please consult your legal counsel):

1. A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
2. Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works at a single online site are covered by a single notification, a representative list of such works at that site.
3. Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit the service provider to locate the material. Providing URLs in the body of an email is the best way to help us locate content quickly.
4. Information reasonably sufficient to permit the service provider to contact the complaining party, such as an address, telephone number, and, if available, an electronic mail address at which the complaining party may be contacted.
5. A statement that the complaining party has a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
6. A statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

Please note that, according to the Copyright Act, any person who knowingly materially misrepresents that material or activity was removed or disabled by mistake or misidentification may be subject to liability. Please also be advised that we enforce a policy that provides for the termination in appropriate circumstances of subscribers who are repeat infringers.
